2. How do we collect information?

2.1 When you conduct a transaction on our website

2.2 When you pre-order any products via our stalls and markets at events. 

2.3 Your personal information you give to us such as name, address, telephone number and email address. Your personal information will be used for specific reasons stated in this policy only.

3.1.2 To provide various products and and operate services to you;

3.1.3 To provide you with ongoing customer assistance and technical support;

3.1.5 To create aggregated statistical data and other aggregated and/or inferred non-personal Information, which we or our business partners may use to provide and improve our respective services; and

4. How do we store, use, share and disclose such information?

4.1 Our Company is hosted on the Wix.com platform. This platform allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

4.2 All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Vsa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. 

4.3 Our third-party service provider such as Google Analytics may store data to provide us with relevant information on browsing actions and usage patterns. 

4.4 Our third-party service provider such as SumUp may store data when purchases have been made at stalls and markets at events. 

4.5 We will not sell or rent any of your personal information to third parties.

5. How do we communicate with you and our visitors?

5.1 We may notify you regarding your purchase or orders, your account problems with your account, to resolve dispute, to collect fees or monies owed, to poll your opinions through survey or questionnaires, to send updates about our Company or as otherwise necessary to contact you to enforce our User Agreement Applicable national laws and any agreement we may have with you by email, telephone or text message via Whatsapp or normal text messaging or postal mail. 

5.2 We may from time to time send you promotional material and other communications such as thank you notes and other communications. 

 

6. How do we use cookies and other tracking tools?

8.2 Any changes will take immediate effect upon posting on our website.

8.3 In the event that changes have been made to our Privacy Policy we may not actively notify you unless you have subscribed to our mailing list, otherwise changes can be viewed on this page. 

8.4 The ‘last updated’ date will inform you of when the policy changed.

1.     Agreement to Terms 

1.1.  These Terms of Use constitute a legal binding agreement made between you, whether personally or on behalf of an entity (“you”) and Trisha C Design Limited, doing business as Trisha C Design (“Trisha C Design”, “we”, “us” or “our”), concerning your access to and use of the http://www.trishacdesign.comwebsite as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). We are registered in the United Kingdom and have our registered office at The Old Farmhouse, Round House Drove, Warboys, Huntingdon, Cambridgeshire PE28 2US. You agree that by accessing the Site you have read, understood and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5.1.  We make every effort to display as accurately as possible the colours, features, specification and details of the products available on the Site. However, we do not guarantee that the colours, features, specifications and details of the products will be accurate, complete, reliable, current or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. 

5.2.  All products are subject to availability, and we cannot guarantee that items will be in stock

5.3.  We reserve the right to discontinue any products at any time for any reason, 

5.4.  Prices for all products are subject to change without notice.

 

6.     Purchases and Payment

6.1.  We accept all forms of payment as provided by our Site platform Wix.com. 

6.2.  You agree to provide current, complete and accurate purchase and account information for all purchases made via the Site. 

6.3.  You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. 

6.4.  We may change prices at any time

6.5.  All payment shall be in GB Pound Sterling.

6.6.  You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorise us to charge your chosen payment provider for any such amount upon placing your order. 

6.7.  We reserve the right to correct any errors or mistakes in pricing, even if we have requested or received payment. 

6.8.  We reserve the right to refuse any order placed through the Site. 

6.9.  We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. 

6.10.  We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

8.3.14. Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site. 

8.3.15. Harass, annoy, intimidate, or threaten any of our employees, volunteers or agents engaged in providing any portion of the Site to you. 

8.3.16. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.

8.3.19. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorised script or other software.

8.3.20. Use a buying agent or purchasing agent to make purchases on the Site. 

8.3.21. Make any unauthorised use of the site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.

8.3.22. Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavour or commercial enterprise. 

 

9.     User Generated Contributions

9.1.  The Site does not offer users to submit or post content. We may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, “Contributions”). 

9.2.  Contributions may be viewable by other users of the Site and through third-party websites. As such, any contributions you transmit may be treated in accordance with the Site Privacy Policy. 

9.3.  When you create or make available any Contributions, you thereby represent and warrant that:

9.3.1. The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party. 

9.3.2. You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and authorise us, the Site and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Use.

9.3.3. You have the written consent, release, and/or permission of each and every identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.

9.3.5. Your Contributions are not unsolicited or unauthorised advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation. 

9.3.6. Your Contributions are not obscene, lewd, lascivious, filthy, violet, harassing, libellous, slanderous, or otherwise objectionable (as determined by us). 

9.3.7. Your contributions do not ridicule, mock, disparage, intimate, or abuse anyone. 

9.3.8. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class or people.

9.3.9. Your Contributions do not violate any applicable law, regulation, or rule. 

9.3.10. Your Contributions do not violate the privacy or publicity rights of any third party. 

9.3.11. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minor.

9.3.12. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap. 

9.3.13. Your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation. 

9.4.  Any use of the Site or the Marketplace Offerings in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site and the Marketplace Offerings.

10.5. You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from all and all responsibility and to refrain from any legal action against us regarding Contributions.

12.2. Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content.

12.6. Any purchases you make through Third-Party Websites will be through other websites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party. 

12.7. You agree and acknowledge that we do not endorse the products or services offered on Third-Party Websites and we will not be responsible for any harm caused by your purchases of such products and services. Additionally, you shall hold us harmless from any losses sustained by you or harms caused to you relating to or resulting in any way from Third-Party Content or any contact with Third-Party Websites.

13.1.4. In our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and

13.1.5. Otherwise manage in Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site and the Marketplace Offerings.

14.4. If you access the Site or the Marketplace Offerings from any other region of the world with laws or other requirements governing personal data collection, use or disclosure that differ from applicable laws in the United Kingdom, then through your continued use of the Site, you are transferring your data to the United Kingdom, and you expressly consent to have your data transferred to and processed in the United Kingdom.

17.2. Trisha C Design Limited and yourself both agree to submit to the non-exclusive jurisdiction of the courts of the United Kingdom, which means that you may make a claim to defend your consumer protection rights in regards to these Terms of Use in the United Kingdom.

22.  Indemnification

22.2. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your own expense, with our defence of such claim. 

22.3. We will use reasonable efforts to notify you of any such claim, action or proceeding which is subject to this indemnification upon becoming aware of it. 

 

23.  User Data

23.1. We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site.

25.5. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.

25.6. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or enforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. 

25.7. There is joint venture, partnership, employment or agency relationship created between you and us as result of these Terms of Use or use of the Site. 

25.8. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. 

25.9. You hereby waive any and all defences you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.
